1. Scope of application

These T&Cs apply to all sales of products offered by Happy & Shiny on the website www.happyandshiny.com . They form the contract between you (the Customer) and us (Happy & Shiny), and are subject to French law.

By placing an order on www.happyandshiny.com , you unreservedly accept these General Terms and Conditions, after having read them. They are available at any time on our website at www.happyandshiny.com/conditions-generales-de-vente and can be downloaded in PDF format.
1.3. Who can order?
Our Terms and Conditions apply to individuals of legal age (over 18 years old) acting as consumers, i.e., for personal purposes, outside of professional activity. By placing an order, you confirm that you have the legal capacity to enter into a commitment and provide truthful information about your identity.
1.4. Exclusion of professionals
Professionals (individuals or legal entities acting within the framework of their commercial, industrial, craft, liberal or agricultural activity) cannot benefit from these T&Cs. If you are a professional and wish to place an order, contact us directly at contact@happyandshiny.com .
1.5. Modifications to the T&Cs
The applicable T&Cs are those in effect at the time of payment of your order (or the first payment in the case of payment by installments). We may modify them at any time, and the updated version will be published on www.happyandshiny.com .
2. How to place an order?
2.1. Ordering steps
To order your spiritual t-shirts from www.happyandshiny.com , follow these steps:

Cart Validation : Once you've completed your selection, review your cart (products, prices, shipping costs) and adjust it if necessary. You'll also have access to the Terms and Conditions, which you can read carefully.

After validation, you will receive a confirmation email to the address associated with your account, containing:

2.2. Refusal to validate the order
We reserve the right to refuse an order for legitimate reasons, including:
- Non-compliance with the T&Cs.
- Unusual quantities ordered for personal use.
- Non-payment of a previous order or ongoing dispute.
- Suspicion of fraud (supported by consistent evidence).
3. Products and availability
3.1. Product characteristics
The essential characteristics of our t-shirts (materials, sizes, designs, etc.) and their prices are indicated on the product pages of www.happyandshiny.com , in French. Although we strive to ensure the accuracy of this information, it is often provided by our suppliers, and we decline all responsibility in the event of an error. Photos, videos or illustrations of the products have no contractual value.
3.2. Availability of products
Our products are available while our suppliers' stocks last, as indicated on each product page. However, we do not reserve stock (except for pre-orders indicated). If a product becomes unavailable after your order has been validated, we will notify you by email, cancel the order for that product, and refund you the corresponding amount. If your order contains other available products, these will be delivered to you, but the delivery costs will not be refunded.
4. Right of withdrawal
In accordance with the French Consumer Code, the right of withdrawal does not apply to custom-made or clearly personalized products, which includes our spiritual t-shirts. You will therefore not be able to exercise this right for your orders on www.happyandshiny.com .
5. Price and payment
5.1. Price of products
Prices are listed in euros, excluding taxes (VAT), customs duties, and delivery charges, unless otherwise stated. They are specified on the product pages and in your shopping cart before validation. Since some products are imported from abroad (outside the European Union), additional taxes (import VAT, customs duties) may apply. These taxes are your responsibility as the recipient and are not included in the displayed price. Check with your local authorities for more information.
We reserve the right to change prices at any time, but products will be charged at the price in effect at the time your order is placed.
5.2. Additional costs
Packaging, shipping, insurance, and delivery costs are not included in the product price. They will be notified to you before confirming your order and added to the total amount.
5.3. Payment terms
Payment is due immediately after order confirmation. We offer several payment methods:

Bank card : Accepted for cards affiliated with a French bank or international cards (Visa, MasterCard, American Express, Maestro). By providing your card number, you authorize the debit of the total amount. Payments are secured via a platform using SSL encryption.

PayPal : Accepted up to €1,000, subject to PayPal's Terms of Service.

Vouchers/promo codes : Can be used for all or part of the order, but are valid only once. Any fraudulent use may result in cancellation of the order.
In the event of payment refusal or non-payment, we may suspend or cancel your order. We also reserve the right to suspend a payment method or verify the customer's identity (for example, by requesting ID or proof of address) to prevent fraud.
5.4. Payment in installments
Exceptionally, we may offer payment in installments, depending on the order amount and our knowledge of the customer. This option is not guaranteed and must be requested at contact@happyandshiny.com .
6. Delivery and Receipt
6.1. Delivery terms
Before confirming your order, we will inform you of the available delivery options, their prices, and an estimated delivery time. We will do our best to meet these deadlines, but in the event of a delay, we will contact you promptly to find a solution. Delivery costs are your responsibility and are included in the total order amount. Customs fees, if applicable, remain your responsibility.
Delivery can be made:
- At the address you provided.
- At a relay point chosen from those offered.
Please ensure that the information provided is correct, as you are liable in the event of delivery failure due to an error.
6.2. Receipt of products
Upon receipt, check the condition and conformity of your order. In the event of an anomaly (damaged or incomplete product), contact our Customer Service at contact@happyandshiny.com within 3 days (excluding public holidays) of receipt. As the importer of the product, you are responsible for customs clearance procedures and payment of customs duties, which are not included in the price charged by Happy & Shiny.
7. Guarantees
7.1. Legal guarantees
We are bound by the legal guarantees provided for by the Consumer Code and the Civil Code:

Legal guarantee of conformity (articles L.217-4 et seq. of the French Consumer Code): You have 2 years from delivery to take action. You can choose between repair or replacement of the product, subject to cost conditions (article L.217-9). You are exempt from proving the lack of conformity during the first 6 months for new or used products.

Guarantee against hidden defects (articles 1641 et seq. of the Civil Code): You can request the cancellation of the sale or a reduction in the price if a hidden defect makes the product unfit for use (period of 2 years from the discovery of the defect).
These guarantees apply independently of any contractual guarantee.
7.2. Manufacturer's warranty
Some products may be covered by a manufacturer's warranty, as indicated on the product page. To benefit from this warranty, contact our Customer Service at contact@happyandshiny.com and consult the terms and conditions included with the product. This warranty does not affect your statutory rights.
8. Protection of personal data
As part of your order, we collect personal data (name, first name, address, etc., indicated by an asterisk) necessary to process your order, manage our customer relationship, compile statistics, and comply with our legal obligations. This data is kept for 5 years after the end of the contract.
They are intended for internal use, but may be transmitted to partners (carriers, payment providers) to fulfill your order. You have rights over your data: access, rectification, deletion, limitation, opposition, portability, post-mortem directives, and withdrawal of consent. Attach a copy of both sides of your ID, your email address, first and last name, and address. We will respond within 1 month. You can also file a complaint with the CNIL (French Data Protection Authority).
9. Intellectual Property
The designs, trademarks, images, texts, and other elements present on www.happyandshiny.com are protected by intellectual property rights belonging to Happy & Shiny or their original owners. The sale of our products does not entail any transfer of these rights.
10. Force majeure
We cannot be held responsible for any failure to fulfill our obligations in the event of force majeure (an unforeseeable event beyond our control). We will inform you as soon as possible in the event of such a situation.
11. Liability
We are not responsible for any loss or damage caused by improper use of our products, including unauthorized modification or alteration.
12. Suspension or Termination of Account
We may suspend or terminate your account if you fail to comply with these Terms and Conditions or applicable laws, without prejudice to any damages. A suspended or closed account may not be used for new orders without our prior authorization.
13. Evidence and archiving
The data recorded by Happy & Shiny (communications, orders, payments) constitute proof of transactions. They are archived for 5 years on a reliable and durable medium, in accordance with Article 1360 of the Civil Code, and can be produced as proof of the contract. 14. Nullity and modification
If any clause of the T&Cs is deemed invalid, it will be considered unwritten, but this will not affect the other clauses. Any tolerance on our part in the application of the T&Cs does not constitute a modification thereof.
15. Dispute Resolution
These General Terms and Conditions are subject to French law (and not Belgian law, as mentioned in the initial text, because Happy & Shiny is based in France in Carry-le-Rouet). In the event of a dispute, please contact our Customer Service at contact@happyandshiny.com for an amicable solution.
